5 Things You Can Do After a Car Accident in Maryland

Being involved in a car accident is traumatic and stressful. It’s important to keep your cool and remember to take the following steps:

1.Call 911 if needed

If anyone is injured, call 911 immediately. If you even suspect someone is hurt, immediately call 911.

2.Exchange Information

You need to make sure you get appropriate contact information for the other party involved in your wreck. This information includes name, address, phone number, email address, make of car, model of car, year of car, license plate number, insurance carrier, and insurance policy number. Often times, the police officer who arrives on scene will obtain information for all drivers, but if there is no officer on scene, obtaining the above information is important.

3.Take Pictures

Take as many pictures as you can of any damage to your vehicle, skid marks on the roadway, debris, injuries, witnesses, license plates and your surroundings/location of the accident.

4.Talk to the Police

If police officers are on scene or are called to the scene, kindly ask for the officer’s name, badge or ID number, phone number and police report number.

5.File Your Claim

Understanding PIP (Personal Injury Protection)

Typical PIP coverage in Maryland provides up to $2,500 for medical, hospital and disability expenses resulting from an accident. Maryland law allows drivers to choose full or limited PIP coverage. Limited coverage is often the cheaper choice. While drivers are not required to carry PIP coverage, insurance carriers are legally required to offer their customers PIP protection. If a driver declines PIP, the customer must sign a waiver rejecting the offer of PIP coverage.

Drivers who carry PIP coverage should be aware that PIP only pays a portion of any medical expenses and/or lost wages. If the injured driver has medical insurance, the health insurance carrier will step in and cover the remaining medical bills once the PIP limit is exhausted. If you are not the “at-fault” driver for the accident, the other motorist’s insurance provider will also be responsible for the same medical expenses or lost income.

Insurance Code Section 19-505(a) states that the persons covered by PIP include the owner of the vehicle or the policy holder/insured, any family members who live with the insured, other individuals who use the insured’s vehicle with his or her consent, guests or other passengers occupying the insured’s vehicle at the time of the accident, or any person injured by the insured’s vehicle while a pedestrian.

Maryland’s insurance statutes also sets a one-year “statute of limitations” (from the date of the accident) for PIP claims to be made. Under Maryland’s Insurance Code Section 19-508, if an insured makes a claim after the 12-month Statute, they may be ineligible for PIP protections and benefits.

If you have medical expenses for up to 3 years after your accident, such as funeral costs, hospital fees, nursing expenses, surgical costs or x-ray costs, PIP covers these reasonable and necessary expenses as well.
