Florida Grand Theft Charges

Florida classifies Grand Theft into three felony degrees, First Degree, Second Degree and Third Degree. Under Florida Statute § 812.014(2)(c)(1) Grand Theft of the Third Degree is a Level 2 severity offense under the Florida Criminal Punishment Code and will get you 10 points on your score sheet as a primary offense.

Third Degree Grand Theft includes:

  1. Theft of property valued at $300 or more, but less than $20,000
  2. Property of $100 or more, but less than $300 taken from the unenclosed curtilage of a home 812.014(2)(d)
  3. Theft of a will, codicil, or other testamentary document
  4. Theft of a firearm
  5. Theft of a motor vehicle (which also carries a multiplier of 1.5 to your score sheet under the Florida Criminal Punishment Code)
  6. Theft of a commercially farmed animal (like a cow, pig or colony of bees)
  7. Theft of a fire extinguisher
  8. Theft of a stop sign
  9. Theft of ANY amount of controlled substance

If you are adjudicated guilty of Third Degree Grand Theft in Florida, you could be sentenced to any of the following:

  • A maximum penalty of up to five (5) years in prison;
  • A maximum penalty of up to five (5) years supervised probation/community control; or
  • A maximum penalty of up to a $5,000 fine

 

Second Degree Grand Theft:

Under Florida Statute § 812.014(2)(b)(1) Grand Theft of the Third Degree is a Level 6 (or 7, depending) severity offense under the Florida Criminal Punishment Code and will get you 36 points on your score sheet as a primary offense.

Second Degree Grand Theft Includes:

  1. Theft of property valued at $20,000 or more, but less than $100,000
  2. Cargo valued at less than $50,000 (stealing a bunch of tv’s off of a Best Buy truck for example)
  3. Theft of medical equipment valued at $300 or more
  4. Theft of a law enforcement vehicle of property valued at $300 or more

If you are adjudicated guilty of Second Degree Grand Theft in Florida, you could be sentenced to any of the following:

  • A maximum penalty of up to fifteen (15) years in prison;
  • A maximum penalty of up to fifteen (15) years supervised probation/community control; or
  • A maximum penalty of up to a $10,000 fine

 

First Degree Grand Theft:

Under Florida Statute § 812.014(2)(a)(1) Grand Theft of the First Degree is a Level 7 (or 8, depending) severity offense under the Florida Criminal Punishment Code and will get you 56 points on your score sheet as a primary offense (automatic prison sentence).

First Degree Grand Theft Includes:

  1. Theft of property valued at $100,000 or more, or is a police deployed semi-trailer
  2. Cargo valued at $50,000 or more (stealing a bunch of tv’s off of a Best Buy truck for example); or
  3. Any grand theft where a vehicle is used in a manner other than as a getaway vehicle or causes damage in excess of $1,000

If you are adjudicated guilty of Second Degree Grand Theft in Florida, you could be sentenced to any of the following:

  • A maximum penalty of up to thirty (30) years in prison;
  • A maximum penalty of up to thirty (30) years supervised probation/community control; or
  • A maximum penalty of up to a $10,000 fine
