Our client was charged with two felonies of Filing a False and Fraudulent Insurance Claim and Grand Theft. The State alleged that our client wrongfully reported his vehicle as being stolen, in an attempt to regain possession of it after an ex-girlfriend had wrongfully taken the vehicle. The vehicle was recovered by law enforcement, the insurance company paid the lien holder, and was now seeking the prosecution of our client was well as restitution in excess of $9,000, even though they had obtained possession of both the vehicle and the title.

The Modarres Law Firm, through aggressive pretrial motions, argument, and negotiations, was able to receive a plea offer to a lesser included offense of petit theft with a withhold of adjudication (so it would not go on our client’s record) and a Nolle Prosequi as to the felony charge of Filing False Insurance Claims (charge was dropped by the State).
