Defendant was stopped in Orlando by an off-duty Orange County Sheriff’s Deputy in an apartment complex parking lot. The Deputy stated that he became suspicious of Defendant’s vehicle, followed him around the parking lot before finally stopping him for illegally parking in front of a fire hydrant. Defendant had a cup of alcohol found in the passenger compartment of the vehicle and subsequently refused to perform field sobriety exercises and refused to provide a breath sample. The Modarres Law Firm set the case for trial and after the State presented their case, Attorney Shayan Modarres immediately moved for a Judgment of Acquittal. The Judge agreed with us and Defendant was acquitted of all charges.
